I want to write a script that will back-up the access.log file when it get's over a certain length, and then start with a fresh one. I was wondering if it's possible to do this without stopping the server, because today I tried to do it by hand and it was saying that the file was in use. Any help will be greatly appreciated.

Why do you want to re-invent the wheel? Use logrotate to do that...
