I do not see the ripoff. I see perhaps a similar design, but checking the Coding, they are both totally different from one another.

Can you perhaps show what exactly is being ripped off?

Not the coding, the design, overall look and feel of the site....the original site was featured on a flash component site...both sites use the same component.

The original background graphic was ripped off as is the overall design scheme.

Ok, the other site is clearly inspired but dude it's ugly. There's JPG artifacts everywhere and the typography, pictures and effects are so cheesy it feels like a farce.

On the other the buddy Kody Chamberlain should make sure the joomla favicon does not replace his. It looks amateur-ish.

Inspired is not ripped - though I agree the BG does look the same. That could be ripped.

Perhaps there is a quibble over the definition of the term "ripped"?

Obviously the 2nd site is not comprised of the same image files or code, but is is just as obviously a very direct copy, as opposed to an 'inspiration'. Every detail is copied, not just the basic concept.


Sleepingwolf - 2 important notes:

1) it happens. in many cases, especially ones like this where the design is generic, there is not much that can be done.

2) note the "Site By MCB Media" in the lower right corner of the copy. Sending an email to the owner of a restaurant attacking them for the fact that the web design company they hired made a knock-off of another site is not likely to be productive or fair.
If you feel contact needs to be made, it needs to either be of a polite, informative nature, and/or needs to go the web design company directly.

agreed - 100% - i doubt the owner even knows what has happened, it is the "media" outfit which is to blame.

and for clarification, i'm staying out of this..i notified Kody who appreciated the heads-up (but not the fact he was ripped)..i did send an email to the MCB guy/gal....polite, but tongue in cheek....congratulating him on his design but also linking back to the original site.

I term "ripped" to be the direct taking of graphics and code from one and using it without permission.

Inspiration, for lack of a better term - how about copying? Copycatting?

To be frowned on by serious, professional designers, to be sure.

I wouldn't do it.

But it is certainly different than ripping, IMHO. I equate ripping with stealing, for that is what it is.

Such as that background. Looks like the same to me.

UPDATE: the ripoff artist has agreed to change his page design...he's started already - and it's easy to see from the crap that he put up as a replacement why he can't do his own design.

I can understand the design concept... It looks inspired.

However, the bistro site does look like a candidate for Webpages that Suck . com's The Daily Sucker.
