Technically virtually any public performance of a copyrighted work requires a royalty payment. You most certainly do pay a royalty when you buy a cd with a certain number acceptable uses of that CD. And there's not royalties for listening there's royalties for performing them, so in your example above the radio station does pay a royalty. DJs at club's etc should be paying royalties but this use is generally not enforced. Band's doing covers also should be paying royalties. I'm not sure about lending a CD to a friend (this may be covered under the use you paid for by buying the CD) but we all know you can't copy a CD and give it away.

These rules are very hard to enforce and generally not pursued in most small situations

I'm still confused as to exactly what you're saying. I know how royalties work...but I don't see how it applies to this...

Perhaps recording studios should start including a EULA in the CD liner notes...
That way, we'll at least know when we're infringing on the artist's rights... whether it's enforced, or we care or not...
