I'd say the site owner needs to do some work on his layout. I started to take the test, but couldn't get past the first page because the test comes up in its own window with no controls on the window and with no way to resize the window or scroll to the continue button (if there is one).

There is a continue arrow there, it's on the bottom right-hand corner of the window; plain sight and all that

I know 'everyone's doing it', but that doesn't mean its legal. Ok - chances are slim that anyone is ever going to prosecute you, but it just takes one bit of bad luck. It may seem easier to take the quick, cheaper option, but they might just clamp down. Nah, you'll be fine? Well maybe not. Yeah its OK? Actually? Ooh. Aah.
