I also see that you have the td width set in two places, in your css and in the <td>. perhaps they are conflicting a bit when there is no content in sidebar. also, I see that you have height for content td, but not sidebar td. don't know how that would have an effect, but it is a difference. also, I have often had bad results with the &nsp as place holders. no magic bullet, just a few ideas.
