I have a new client. The job involves the creation of a marketing campaign plan, some pr stuff, and the creation of a web site. Running the marketing campaign will be a monthly fee - kind of a retainer. PR pieces will be created (and billed) on a case by case basis.

For the web site:
I've read people around here say one should estimate hrs * bill rate = Flat Rate Total.
Then, divide that Total by three. 1/3 due at the start of the project, 1/3 due at the mid point, 1/3 due at the end.

That sounds like a good plan and I'd like to write that into the web site contract.
My question is, how do you define "midpoint"? Is it a pre-agreed upon time (based on the hrs estimate)? Is it based on a specific task being accomplished? How do you write that into the contract?

Advise, please. Thank you.

in our project agreements we lay it out like so:

1. PERFORMANCE
(Time guidelines provided below are milestone execution targets for CLIENT and FIRM.
CLIENT must furnish all content related materials by the start of point 1.2 below
in order to move forward from that point)

1.1. Technical Setup [72 hours]
1.1.1 Acquire domain(s)
1.1.2 Initiate hosting services
1.1.3 DNS propagation (domain/site accessible)
1.2 Web Site design [Target Finish: Week X]
1.2.1 Organizational Mapping
1.2.2 User Interface Design
1.2.3 Graphic Design
1.2.4 Flash animation
1.2.5 Submit visual and user interface design for Review/Revisions/Acceptance
1.3 Web Site build [Target Finish: Week X]
1.3.1 Template Markup
1.3.2 Standard Search Engine Optimization practices
1.4 Web Site finishing [Target Finish: Week X]
1.4.1 Content review/revision (copy editing/writing)
1.5 Web Site goes live [Target Finish: Week X]

2. PAYMENT.
CLIENT agrees to pay to FIRM an initial sum of
$XXXX.00
upon execution of this agreement. An additional
$XXXX.00
will be due at the halfway point of development, namely point 1.3 above
(after acceptance of design). All remaining charges
$XXXX.00
agreed upon, and which may accrue (based upon additional rider(s) to this agreement)
shall become due and payable to FIRM upon completion of the project, namely point 1.5
above. Terms are WHATEVER. FIRM reserves the right to remove work from access via
Internet until final payment is made. Should collection activities become necessary,
the CLIENT agrees to pay all fees relating to said activity.



Mid point could be a very variable spot depending on the scope of the work and your process but that works for us 99% of the time. Gernally speaking, and according to my process, midway is usually the spot between design acceptance and building.
