This is in this case false. The server does not work at all. I tried to ping the server and it didn't answered at all. Launch the MS-DOS commands (if you are under Win2000) and type : "ping www.wapod.com".
You will get a "Unknown host" error. Normally, even if the server does not answer, you get an information saying you have lost all the packets and indicating the IP of the server.

I suppose it depends on the situation. If you are hosting a personal site and its a reoccuring issue, you can either bite the bullet and accept that your hosting isn't overly reliable or ask for a refund and take your business elsewhere. If the site being hosted is a commercial site, where maximum uptime is required, if the host goes down for an unreasonable about of time, causing you a loss in business I suppose you can take legal action.

Of course all hosts go down every now and then.

Sooner or later, all hosts suck indeed. This 99.9999% uptime advertisement is always fallacious. I have only a few but important tips: (1) never pay a whole year in advance, pay monthly; if you lose money, you lose a lot less and the discount is get for paying anually is not worth the risk; (2) choosing a cheap host means that your chances of having problems are much bigger; (3) if your site is for business and you will lose money if it goes down for a while, never choose a cheap host; (4) finally, never expect to have a perfect host because they have humans taken care of them and they have Linux/Unix/Windows/Apache etc. software running on them, that are also made by humans and humans are far from perfect creatures.
I use a cheap host ($10/month) because I lose nothing if my whole site goes down.
