Topic: Logo design problem (Page 1 of 1)

Here is the deal and I would like to know how you think I should handle this.

I made a logo for a gaming web site. They used the logo but they took out part of it. That kind of pissed me off. Then I just saw on a graphics page where the guy was wanting people to make him a logo for his Cafe Press stuff using my logo.

I am going to contact him and see what is up but I just wanted to hear what you all thought.

I mean, I made the logo that he cropped and put on his site. Then he used my full logo for his Cafe Press stuff and now he wants people to make another logo using my stuff. Does anyone else see anything wrong with that or is it just me?

Seems to me, the *rightness* or *wrongness* depends on the arrangeement you made with him.
Did money change hands ?
Was the ownership of copyright issue discussed ?
Was there a contract that declares any of the copyright issues ?

Or did he just hike your logo ?

No copyright issues were discussed. I didn't think that he would have someone use my logo for something else. I guess I might be screwed

CPrompt: I suspect you might be. However, it depends on exactly what was said at the time - if you have records of your correspondance then you might be able to do get something from the verbal agreement. Do you just want more credit or a cut of the cash? If it is the former then they might be fine with that if you say that it would help you with assembling a portfolio. If it is the latter then I doubt you'll get much joy.

Just be more careful with how you pass your stuff around and who you give it to.

yep, live an learn. I was just wanting credit. I did speak with them about it and this is what he is doing, tell me if this ins't strange. . .


He uses my logo for the website and just cuts a part of it off. Uses my full logo for some coffee mugs and t-shirts and does something totaly different for a mousepad. !! Whatever man. I have some screen shots of the site with my logo for a portfolio. So, that's cool I guess.

I really don't know much about the legal stuff, but it seems to me that unless you explicitly told him otherwise, the copyright for the logo is still yours. Sure, you gave him permission to use it, if he credited you in return. That does not give him the right to modify it, and to use it for things other than you intended. I image you did not discuss what he should use the logo for, but if it was implied that it was on a web site only, it seems to me that he should not use it for anything he pleases.
You are still the owner of your logo design, or so I would think.

But as I said, I don't know much about all these crazy legal things.

Well, I really wanted him to use my full logo. But he didn't. He only used in on the Tshirts and stuff. When he put it on the site it looked like crap because it butted right up against the top of the page and he cut half of it off.

I don't think I will cause a big stink over it but it just looks like crap on the site really.

I'll show you the logo I did and then the page that he used it on.

CPrompt: He hasn't massacred your work so I think your best move might be dropping him some advice on placing the logo further to the right as you are right that it doesn't look great in that position (the original was probably a bit too high to work as a logo in that position but would work better as a variant for T-shorts and mousemats so I can see why he has done what he did). I would also check the exact wording of what was said when you were discussing the use of the logo and see what you can find there.
