To be honest, I really don't know how well this lawsuit would really hold up in any respected court of law. You can't copywrite a last name, and this is pretty much what there asking. |

In fact this guy could realistically argue that he's been using the name Nissan since 1951 but it has been in his family since nearly the beginning of time, long before anyone ever heard of Datsun or later Nissan. |

I agree. In fact, he could probably countersue that the company itself had infringed on his civil rights by using his personal name for their company without consulting him or his family. |

I think that Nissan Auto is concerned for the domain name since he took it from them. I think he will and should win this law suit. |

of course you can copywrite a name, as copywriting is simply writing copy......and copy is simply text, which can of any nature relevant to the context in which it is being written. |
